This item was reviewed by the Planning Commission at a Public Hearing on November 13, 2020. The Planning Commission voted 9-0 to forward a recommendation of approval to the Mayor and Council.

YOU ARE INVITED TO ATTEND A PUBLIC MEETING ON THE PROPOSAL TO AMEND THE UNIFIED DEVELOPMENT CODE (UDC) TO ALLOW FOR A RIGHT-OF-WAY ABUTTING A SUBJECT PROPERTY TO BE INCLUDED IN THE CALCULATION OF THE REQUIRED NOTICE AREA. On May 10, 2017, the state legislature passed a law adding the requirement to include municipal right-of-way in the measurement of rezoning protest notifications and calculations. Currently, the City of Tucson Planning and Development Services Department (PDSD) is seeking feedback regarding a proposal to change the method of calculating the required area that is notified for certain land use actions. This amendment would change the existing policy which does not include an abutting right-of-way in the calculated notification distance. The proposed change reconciles the UDC with the newly adopted Arizona Revised Statute requirement while keeping the required notified parties roughly the same as calculated under the current conditions.

At this Public Meeting, PDSD staff will give a presentation to help everyone understand the existing required notice area measurement standards, what options may exist to include an abutting right-of-way in the notice area calculations, and then facilitate a discussion for participants to share their opinions, observations and suggestions regarding the proposed notification text amendment. This feedback will be essential to staff’s review of this issue and what will ultimately be presented to the Planning Commission and Mayor and Council.
