Supervised Probation

Supervised Probation is ordered by a judge as an alternative to incarceration and allows the convicted person to remain in the community.

The purpose of probation is threefold:

  • To ensure that the orders and requirements imposed by the Court are met
  • Ensure public safety
  • Provide for the rehabilitation of the offender

The maximum period of supervised probation as determined by Arizona law is:

  • Class 1 misdemeanor - three (3) years, with the exception of DUI convictions which is five (5) years
  • Class 2 misdemeanor - two (2) years
  • Class 3 misdemeanor - one (1) year

When the court has required, as a condition of supervised probation, that the defendant make restitution for any economic loss related to the defendant’s offense and if that condition has not been satisfied, the court at any time prior to the termination or expiration of supervised probation may extend the period for not more than one (1) year.

When the court imposes a term of supervised probation on a defendant they are assigned to a contracted probation monitoring officer who will monitor and assist them. The defendant may be ordered to pay fines, fees and restitution, participate in counseling or substance abuse treatment programs, submit to breathalyzer and urinalysis testing, and abstain from alcohol. The probation monitor will interview the defendant and make the appropriate referral to counseling, treatment or mental health programs and monitor the defendant to ensure adherence to the conditions of probation. The defendant must cooperate with the probation monitor in complying with the specified terms and conditions of supervised probation. If the defendant violates the conditions of probation the probation monitor initiates a petition to revoke probation and testifies in court as a witness during hearings on these matters.

The vendor contracted to provide supervised probation service is located on the 4th floor of Tucson City Court, Room 401. All persons assigned to supervised probation are required to make initial contact with a probation monitor in person.
